The Moscow City Duma is elective, permanent representative legislature of the city of Moscow.
The Charter of the City of Moscow determines a four-year term of appointment of deputies of the City Duma.
On December, 16, 2001, elections to the Moscow City Duma of the third convocation took place. People with different vital and professional experience, supporters of a wide spectrum of political views came into the deputy corps.
For effective activity of the joint authority and management in January, 1994, deputies adopted the Decree of the Moscow municipal duma under N 1 " Rules of the Moscow City Duma", and in February, 1998, deputies of the second convocation adopted new edition of the Rules, actual nowadays.
Expressing the will and interests of inhabitants of the capital, in June, 1995, the Duma adopted the Charter (Principal Law) of the city of Moscow.
The document proclaims: "the source of power in the city of Moscow are the dwellers of Moscow possessing the suffrage according to the legislation. They realise their authority directly, and also through the official bodies of Moscow City and institutions of local government. " As the basic document determining the legal status of Moscow, city of federal significance - the subject of the Russian Federation, - capital of the Russian Federation, the Charter formulates the main principles of organisation and realisation of state power and local self- government in the city of Moscow, differentiates the spheres of powers and the responsibility of bodies of representative and executive authorities, determines the principle of territorial division of Moscow.
According to the Charter lawmaking is a mainstream of the Duma activity. The right of interpretation of the city acts and the control over their execution in the territory of Moscow is also assigned to the legislature, except for the Charter of City of Moscow,.
Consideration and adoption of draft city budget, draft budgets of territorial state unappropriated funds of Moscow City, and also the control over their execution is an exclusive prerogative of the Duma. During determination of the profitable part of the budget, regional and local taxes and tax collections, the order of granting privileges thereupon, and also the particular rates and tax privileges under federal taxes are established by laws of the city, within the limits of the rights given to subjects of the Russian Federation by the federal legislation. According to the Charter, the City Duma determines the order of activity of institutions of local government, establishes the order of registration of charters of municipal units and distribution of incomes of regional taxes, other incomes of the city of Moscow between the budget of the city and budgets of municipal units, and also establishes sources of incomes of budgets of municipal units and association or transformation of municipal units, delimitation or change of their territories in view of opinion of the population of municipal units. For realisation of control functions, the Moscow City Duma is empowered to express mistrust to Mayor of Moscow and other officials, in whose appointment the Moscow City Duma took part, in cases and the order, stipulated by the federal legislation and the Charter of the City of Moscow.
As a representative body of power of a subject of the Russian Federation, the Moscow City Duma agrees to appointment of the Public Prosecutor of Moscow, the Chief of Central Board of Internal Affairs of the city, the Head of Judicial Department at the Supreme Court of the Russian Federation in the city of Moscow, judges of Arbitration Court of Moscow, the Moscow City Court, district courts of the city of Moscow, adoption of the general list of jurymen submitted by institutions of local government, and also appoints Justice of the Peace of Moscow and, on declaration of Mayor of Moscow, appoints judges of Charter Court of the city of Moscow.
The Moscow City Duma as a legislature of a subject of the Russian Federation possesses the right of the legislative initiative in the State Duma, the right of election of a representative from the Moscow City Duma and of coordination of assignment of a representative from executive authority of the city of Moscow to Council of Federation of the Federal Assembly of the Russian Federation in the order established by the federal law and legal acts of the city of Moscow. The representative in Council of Federation of the Federal Assembly of the Russian Federation from the Moscow City Duma is Vladimir Konstantinovich Plotnikov.
